Welcome to Sancer Productions. By engaging our photography services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before booking or using our services.
1. Services Provided
Sancer Productions offers professional photography services, including but not limited to headshots, model portfolios, and editorial photography. Specific services and deliverables will be outlined in your individual agreement or booking confirmation.
2. Booking and Payments
2.1 Booking Confirmation: Your session is confirmed only upon receipt of a non-refundable retainer, as specified at the time of booking.
2.2 Payment Terms: For mini-sessions, full payment must be received at least 48 hours before the scheduled appointment. For sessions lasting one hour or more, full payment must be received at least 14 days before the scheduled appointment. Failure to meet these deadlines will result in the forfeiture of the appointment and the non-refundable retainer.
2.3 Refund Policy: The retainer is non-refundable. No refunds will be issued for same-day cancellations, reschedules, or no-shows unless consideration is given for unforeseeable circumstances (e.g., weather, injury with proof). If Sancer Productions cancels the appointment, a full refund will be provided within 3-5 business days of the cancellation.
3. Use of Photographs
3.1 Client Usage: You are granted a non-exclusive, non-transferable license to use the photographs for personal or professional purposes, as agreed upon prior to the session.
3.2 Sancer Productions’ Usage: By engaging our services, you consent to the use of photographs from your session for marketing and promotional purposes, including but not limited to our website, social media platforms, portfolio, and advertisements. If you wish to opt out, you must notify us in writing at sancerproductions@gmail.com before your session.
4. Intellectual Property
4.1 All images captured by Sancer Productions remain the intellectual property of Sancer Productions. Any unauthorized reproduction, distribution, or modification of the photographs is prohibited.
4.2 High-resolution images will be provided for agreed-upon uses; however, raw files remain the property of Sancer Productions and will not be released unless otherwise stated in writing.
5. Liability
5.1 Service Quality: While we strive to deliver high-quality images, the final results may vary based on conditions beyond our control, including but not limited to lighting, weather, and client cooperation.
5.2 Damage or Loss: Sancer Productions is not liable for any damage or loss of photographs once delivered.
6. Client Responsibilities
6.1 Session Preparation: Clients are responsible for arriving on time and prepared for their scheduled session. Delays may result in reduced session time or additional fees.
6.2 Approvals: Clients must review and approve proofs or draft images within the timeframe specified. Delayed approvals may result in additional processing time.
7. Data Protection
We value your privacy and handle your personal information in accordance with our Privacy Policy. By using our services, you agree to the collection, use, and storage of your information as outlined in the Privacy Policy.
8. Changes and Amendments
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The latest version will always be available on our website or provided upon request.
9. Governing Law
These Terms and Conditions are governed by the laws of Maricopa County. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Maricopa County.
